Madurai Bench High Court Advocates’ Association has filed a petition before the Madurai Bench of the Madras High Court seeking an inquiry into the matter and payment of appropriate compensation for the advocate,Following an alleged assault on an advocate by policemen in Usilampatti,
A division bench of Justices M. Sathyanarayanan and R. Hemalatha directed the Deputy Superintendent of Police to continue the investigation into the case and the Deputy Inspector General of Police and Judicial Magistrate to monitor the investigation. The DIG was directed to submit a status report on April 10. The court also said no final report should be submitted in the case until further orders.
The petitioner, advocate T. Chandrasekaran, secretary of the association, said advocate P. Balan, a member, was allegedly assaulted by a Sub-Inspector of Police following an altercation. He said while the police were roughing up one O.S. Pandi, Mr. Balan intervened and asked them to stop.
The petitioner alleged that Mr. Balan was beaten up indiscriminately by the 10 policemen in plainclothes, in which he sustained grievous injuries to him. Following the incident, he was admitted to Usilampatti Government Hospital. A case was registered with Usilampatti Town police station.
Even though an FIR was registered in the case, no action was taken against the SI and the others. Meanwhile, Mr. Balan was admitted to Meenakshi Mission Hospital in Madurai for further treatment.
The petitioner wanted the investigation to be handed over to the CB-CID. He also sought an inquiry by a Chief Judicial Magistrate and payment of compensation for the advocate for the injuries he suffered.
