UP government questioned by NHRC on Unnao Incident

The National Human Rights Commission-NHRC has issued notices to Uttar Pradesh government and police in the mysterious death of the father of a rape victim who was in custody at a jail in Unnao
The incident happened a day after the alleged rape victim tried to immolate herself near the Chief Minister’s residence, accusing BJP MLA Kuldeep Singh Sengar and his aides of gang raping her.
The girl’s father was in judicial custody after his arrest for a brawl with the MLA’s supporters last week. The daughter of the deceased has alleged that it is only the delinquent MLA who got her father killed since she was not willing to withdraw the complaint against him.

NHRC has observed that the allegations, if true, raise serious issue of violation of human rights of the victim family. NHRC has issued notices to the Chief Secretary and the Director General of Police, Uttar Pradesh, calling for a detailed report in the matter, including action taken against the delinquent police officials, who refused to register an FIR and also expects from the DGP, an explanation for not communicating the custodial death to the Commission within 24 hours. All the reports, including health screening report of the deceased at the time of his admission in the jail and medical treatment provided by the jail authorities, are to be sent. They have been given four weeks to respond.
The Commission has also directed the Chief Secretary of Uttar Pradesh to look into the matter personally and ensure that the aggrieved family is not subjected to further harassment and humiliation by the opponents who appear to be resourceful persons of the locality. It has been alleged that some miscreants forcefully entered into the house of Devender and thrashed him brutally in front of his family members on April 3. The family approached the Makhi police station to lodge an FIR against the younger brother of the BJP MLA and his aides.

It was mentioned in their complaint that the brother of the MLA led the group and asked his accomplices to attack the family. The FIR has been reportedly lodged but it, allegedly, does not mention the name of the brother of the BJP MLA.

On the other hand, the police booked Devender under various sections and arrested him.
After medical examination of Devender, he was sent to prison at 7.30 pm on April 4. In the evening, he complained of stomach ache and the next day he died in the hospital.

The daughter of the deceased, who has levelled allegation of rape against the MLA and his associates, has, reportedly, stated that since Unnao police had refused to act against the MLA, his brother and accomplices, they were forced to move the Court to get an FIR registered. She had met the Chief Minister on August 17 last year to raise her grievance and she was assured help but nothing happened.

According to the reports, the doctors who examined the deceased after he spent two days in police custody noted 19 injury marks. He was taken to hospital only when his condition deteriorated. Within few hours of his death, Unnao police arrested the group of four persons who were responsible for attacking Devendra. SHO of Makhi police station along with five more police personnel were placed under suspension. Unnao police managed to arrest Atul Singh Sengar, younger brother of MLA who led the violent group who charged at Devendra last week.

The panel of doctors which conducted postmortem examination on the intervening night of Monday and Tuesday, noted down 14 ante-mortem injuries on Devendra’s body. The panel also found two of his teeth were broken recently and fresh injuries in jaw. Unnao DM and SP were camping at the mortuary till postmortem examination got over. A source involved with the PM examination revealed that severe infection had spread within gastrointestinal tract of girl’s father leading to sepsis in abdominal region. Former director of UP’s medico legal cell and forensic expert Dr YK Pathak said that it is clear that infection kept worsening and jail authorities or doctors posted at Unnao district hospital ignored Devendra’s medical condition. Devendra complained of acute abdominal pain to jail doctors repeatedly. But neither jail staff nor doctors attending to Devendra at Unnao district hospital took steps to contain the infection which led to damage to his vital organs leading to his death. Pathak said that it appears that assailants punched Devendra in his stomach repeatedly leading to rupture in his intestines and other internal organs. Doctors have preserved Devendra’s body parts for viscera examination that would take place at Mahanagar forensic laboratory.

The survivor had tried to immolate self on Sunday near the chief minister’s house in high-security zone alleging that police were not acting on her complaint against local BJP MLA, who, she said, raped her last year. The security personnel present there got hold of the woman before she could light the fire after pouring kerosene oil on her body and handed her over to the local Gautam Palli police.

The woman alleged that the BJP MLA and his aides had raped her in May 2017, but police took no action on her complaint.  Atul singh sengar  younger brother of kuldeep singh sengar, BJP MLA from Bangarmau, was arrested by the Lucknow crime branch on Tuesday morning in connection with the death of Unnao gang rape survivor’s father in jail. Unnao SP Pushpanjali Devi said that Atul has been arrested against crime no: 90/18 under sections 147,323,504 and 304 of IPC from Unnao by crime branch team of Lucknow headed by SP crime Dinesh Singh.
