The complainant, Bheemarajan of Madurai, a tailor, said that he had approached Dr. S. Karthick in 2008 for treatment after experiencing severe body pain. Dr. Karthick diagnosed it to be a case of jaundice and suggested surgery. The surgery was performed at Ponni Hospital, Madurai, in May 2008. However, even after surgery and subsequent treatment, the complainant did not recover from the ailment.
It was only after the complainant consulted Government Rajaji Hospital and another private hospital that he found that the doctor was not a qualified person to perform spleen removal surgery, which was done without the consent and the knowledge of the complainant. The spleen which was normal was unnecessarily removed.
The complainant claimed that the removal of the spleen had affected his routine work and caused severe health complications. He said that the act by the doctor which amounted to medical negligence had caused heavy medical expenses and mental agony for him.
A legal notice was served on the doctor seeking compensation but as there was no response, the consumer forum was approached for relief.
The Madurai District Consumer Disputes Redressal Forum, taking into consideration the mental agony suffered by a victim of medical negligence, has directed the doctor who treated him erroneously to pay the victim a compensation.
The forum, comprising president V. Balasundarakumar and member M. Maraikamalai, directed the doctor to also pay Rs. 75,000 towards operation charges and medical expenses, Rs. 50,000 for the mental agony and physical strain undergone by the victim, and a cost of Rs. 3,000.
